Litigation

General commercial litigation in Federal and State courts and before domestic and international arbitral tribunals for both U.S., and foreign clients in the areas of employment law, commercial disputes, contracts, health law, and products liability and toxic torts. Representation of clients in arbitrations and mediations before the AAA, ICC, NASD and NYSE and in private arbitrations and mediations. Representation of clients in connection with various internal investigations.

Employment Law

Personnel Advice-Drafting employee manuals, personnel policies and employment contracts; providing advice concerning terminations, wage/hour regulations, disability laws and regulations, FMLA, smoking law compliance, drug testing, polygraph testing, unemployment and workers compensation issues, performance evaluation issues, disciplinary actions and severance issues; conducting sexual harassment investigations and training; and consulting concerning reorganizations, relocations and reductions-in-force, WARN Act notifications and COBRA issues.

Employment Contracts-Preparation and negotiation of employment contracts for clients, including brokerage and financial services organizations, international sales companies and advertising companies; negotiation of severance agreements.

Litigation-Representation of corporate clients in both Federal and State courts, arbitral tribunals and federal and state administrative agencies n connection with Title VII/employment discrimination cases, breach of contract cases and wrongful termination cases.

Architect/Engineering Firm Successfully represented client in employment discrimination claim based on national origin; obtained dismissal of multimillion dollar breach of contract, malpractice claim; obtained summary judgment dismissal of shareholder action.
Broker/Dealer Representation in all aspects of employment law and litigation, including breach of contract/fiduciary duty cases, discrimination litigation, employment contracts and policy issues.
