Practice Description
Litigation, focusing on Pesticides, Environmental, and Chemical Control.
Mr. Putsavage has over 25 years of experience in environmental law and regulation with a significant focus on pesticides. He counsels pesticide producers, distributors, retailers and trade associations on federal and state pesticide regulatory and business matters, including product registration and cancellation, federal and state enforcement, and data compensation. He also counsels clients on e-commerce and Internet related trade issues.
Data compensation under the Federal Insecticide, Rodenticide and Fungicide Act is a focus of Mr. Putsavage's practice. He has represented both owners and citers of data, and has succeeded in bringing many matters to a successful negotiated conclusion without arbitration. Among the unique issues he has addressed is one of only two successful appeals of determinations by the American Arbitration Association to appoint three arbitrators over the objection of one of the parties. He is particularly well versed in issues arising from federal preemption of state pesticide law, having developed successful litigation strategies in precedent-setting cases.
