U.S. Bank is Indenture Trustee for New Securities Issued in Wolverine Tube Inc.’s Emergence from Bankruptcy
Litigation partner Franklin Ciaccio, assisted by associate Theodore Y. McDonough, represented firm client U.S. Bank National Association as indenture trustee through the Wolverine Tube Inc. bankruptcy filing and proceedings, now culminating in Wolverine Tube Inc.’s successful emergence from Chapter 11 protection. Mr. Ciaccio guided U.S. Bank National Association in the advantageous resolution of all litigation stemming from the bankruptcy filing. Thereafter, corporate partner David J. Fernández and associate Melissa E. Paparone represented U.S. Bank in connection with the issuance of $30 million in new notes pursuant to an indenture with respect to which U.S. Bank will serve as indenture trustee. This was accomplished upon the retirement of all outstanding debt in accordance with Wolverine Tube's restructuring plan.
