Collector’s Claims Against Renowned Artist Robert Indiana Dismissed from Federal Court

This week Judge Deborah A. Batts (S.D.N.Y.) granted our client Robert Indiana’s motion to dismiss a lawsuit by collector Joao Tovar relating to sculptures that are not Mr. Indiana’s work. Robert Indiana is the renowned artist who created the iconic “LOVE” painting and sculpture. The complaint asserted only state law claims, which Judge Batts dismissed on the grounds of lack of subject matter jurisdiction, recognizing that there is no complete diversity where the plaintiff is a citizen of Monaco and one of the co-defendants is a permanent resident alien of the U.S. and a British citizen. Gary D. Sesser, Ronald D. Spencer, Judith Wallace and Chlo├ę D. Coravos represented Robert Indiana.
