Carter Ledyard Counsel Valentino Vasi was quoted this week in an article published by Ignites Financial, which examines recent cybersecurity guidance from the SEC on company disclosure of cyber vulnerabilities, and when to notify clients of a breach. When asked about the potential impact of the SEC’s guidance, Mr. Vasi explained, “It has no bite to it,” and went on to suggest, “I don’t think there’s anything in this guidance that would prevent the Equifax board from reaching the same conclusion that they didn’t do anything wrong after their breach.” Last year, Equifax did not disclose their cyber breach until many weeks after they were informed.
