Cosmos European Travels AG Wins Summary Judgment
On Friday, July 26, 2002, the U.S. District Court for the Eastern District of Virginia granted our client Cosmos European Travels AG complete relief on summary judgment -- ruling that the cosmos.com domain name must be transferred to our client, and enjoining Eurotech or any of its successors from using cosmos.com, cosmotravels, cosmotravels.com or any confusingly similar marks in U.S. commerce. The Court had previously dismissed Eurotech's claims that, by prevailing in the prior Uniform Domain Name Policy ("UDRP") against Eurotech, Cosmos AG was liable for abuse of process, tortious interference with prospective business, and conversion under state law.
