Martin Act: Robert A. McTamaney Quoted by Reuters Regarding Lawsky Nomination
On May 16, corporate partner Robert A. McTamaney was quoted regarding Governor Andrew Cuomo’s nomination of Benjamin Lawsky to head the Department of Financial Services, a new agency formed to regulate the banking and insurance industries. Mr. McTamaney stated, “Vigorous enforcement by a guy with his qualifications and background is what is needed, but he’s being handed a job that has already been supplanted by federal legislation [The Martin Act].” Mr. McTamaney discusses this federal legislation in more detail in his May 2011 Wall Street Lawyer article entitled, “The Assured Guaranty Case & New York’s Martin Act: Pre-emption Delayed is Justice Denied.”
