New York Court Enforces Non-competition Agreements Against California Employees
Carter Ledyard & Milburn LLP successfully obtained a preliminary injunction enforcing noncompetition provisions in employment agreements of California employees of a New York-based financial services company. The case reinforced a recent prior decision of the Federal District Court for the Northern District of New York upholding the contracts drafted by Carter Ledyard for the company, this time specifically addressing the enforceability of New York choice of forum and choice of law provisions in the contracts. In a lengthy and detailed opinion the court reasoned that California public policy against non-competition agreements in employment agreements did not outweigh New York's interests in protecting New York-based nationwide businesses utilizing reasonable restrictive covenants to protect their trade secrets and client good will. The client was represented by Lawrence F. Carnevale and Emily Milligan.
