Trade Secrets and Non-Competition; Second Circuit Win
Carter Ledyard carried its success in The Northern District of New York through emergency applications before the Second Circuit Court of Appeals to preserve a preliminary injunction enforcing its client’s non-competition agreements. The case is noteworthy not only for continuing to crystalize New York law on the enforceability of non-compete clauses, but also because the court determined to follow choice of forum and choice of law provisions and apply New York over California law, despite the fact that California outlaws non-compete agreements in most circumstances. The client was represented by Lawrence F. Carnevale and Emily Milligan.
