Condemnation Law: Obtaining Possession of Acquired Properties, West Harlem, NY

Carter Ledyard represented Empire State Development, a New York corporate governmental agency, in connection with obtaining possession of the remaining properties required to proceed with Phase I, Stage 1 of ESD’s Columbia University – Manhattanville Project in the West Harlem section of Manhattan. Title to the properties was acquired by eminent domain on March 12, 2012. Upon transfer of the properties to Columbia, Columbia will have title to three full city blocks, as well as fee and easement interests in subsurface portions of adjacent city streets and title to other nearby properties, allowing it to continue with its development of major educational and research facilities at the 17-acre Project site. Possession was obtained through extensive relocation efforts and issuance of necessary Writs of Assistance by the New York State courts. Possession of the final properties was transferred to ESD in October.
