Partner Frank Ciaccio Argues before the Sixth Circuit Court of Appeals

Litigation partner Franklin Ciaccio appeared before the United States Court of Appeals for the Sixth Circuit on December 6, 2012, arguing an important appeal on behalf of U.S. Bank, National Association. Before a three-judge panel of the Sixth Circuit, Mr. Ciaccio sought the reversal of a decision of the District Court for the Northern District of Ohio, asserting that the District Court erred in enforcing an alleged settlement agreement among numerous claimants in a complex interpleader action. Mr. Ciaccio argued that the evidence clearly established that U.S. Bank did not agree to enter into the purported agreement. The case arose out of the bankruptcy proceedings of The LTV Corporation, in connection with which Mr. Ciaccio represented U.S. Bank, in its capacity as successor Trustee, under an Indenture, governing certain 11.75% Senior Notes, in the aggregate principal amount of $250,000,000, issued by The LTV Corporation.
