Gary Sesser Quoted by Online Media Daily Regarding Apple EBooks Antitrust Case

Litigation partner Gary D. Sesser was quoted in the July 12 Online Media Daily article “Ebook Damages Could Take Big Bite Out Of Apple,” which reported on the recent court decision finding Apple liable for price fixing in connection with the sale of ebooks.  Commenting on the upcoming hearings on monetary damages, Gary Sesser noted that damages may be “particularly fertile ground for disagreement” because the $9.99 charged by Amazon may not have been a sustainable price.  For its part, Apple will almost certainly appeal both the finding of liability and damages. “It’s difficult to predict how appellate courts will view any case, but that’s especially true here, given that there don’t appear to be previous cases with facts similar to the one against Apple,” Sesser says.
