Fiduciary Litigation

Building on the strengths of our nationally recognized Trusts & Estates and Litigation Departments, Carter Ledyard & Milburn LLP is a leader in the field of fiduciary and trusts and estates litigation.

Our Fiduciary Litigation Group has extensive experience representing trust companies, financial institutions, charitable organizations, family members involved in closely-held companies, and individuals, as executors, trustees, and beneficiaries. Members of the Fiduciary Litigation Group provide advice in connection with will, estate, trust, and fiduciary disputes, including will contests, contested accountings, disputes over ownership of property, questions and disputes regarding the fiduciary obligations of executors and trustees and the proper administration of trusts and estates, questions concerning the proper interpretation of will and trust provisions, guardianship matters, and tax disputes. We represent clients in matters ranging from modest disputes to significant litigations, and our attorneys are trained to objectively evaluate cases and strive to achieve our clients’ objectives in the most cost-effective manner.

The Fiduciary Litigation Group’s lawyers handle complex and sometimes contentious litigation in New York Surrogate’s Court and Supreme Court, as well as in other courts and jurisdictions, and are able to draw on the expertise of lawyers from our Art Law, Tax, and Tax-Exempt Organizations Groups, in addition to our Trusts & Estates and Litigation Departments. Recognizing the desire of many clients to resolve family disputes privately, the Group also has extensive experience with confidential methods of dispute resolution, including private negotiation and mediation.
