Carter Ledyard Client Teglasi Granted Summary Judgment

On Tuesday, July 21, 2015, the Appellate Division, First Department ruled in favor of the firm’s clients in an appeal of a trial court decision denying their summary judgment motion. The appellate court reversed the trial court’s decision in Dreisinger v. Teglasi and granted the summary judgment motion. The case involved owners of two New York City tax lots that the Department of City Planning treats as one zoning lot. This arrangement is common in New York City, but often gives rise to disputes about the allocation of development rights among neighbors. In this case, the parties failed to specify the allocation of such rights at the time of purchase of the tax lots, giving rise to this litigation years later. Environmental Co-Director Christopher Rizzo argued for the firm’s client. Noah Hertz-Bunzl assisted in the litigation.
