Alan Lewis, Chair of Carter Ledyard’s Internal Investigations and White Collar Defense Practice Group, presented “Post-Conviction Relief Motions: Writs (2254 & 2255), Coram Nobis, & CPL 440,” on September 30th, 2022 to the New York State Association of Criminal Defense Lawyers (NYSACDL), an organization he serves in various capacities including as Chair of its Judicial Screening Committee, Executive Committee Member and Treasurer.
The presentation focused primarily on remedies available in federal court to challenge criminal convictions after the conclusion of the direct appeal process. Alan presented an overview of four specific mechanisms – habeas corpus petitions for those convicted of state offenses, motions to set aside federal convictions under 28 USC 2255, applications for writs of error coram nobis, and motions to vacate under Section 440 of New York’s Criminal Procedure Law. Alan’s program included examples taken from his decades of experience litigating post conviction motions of behalf of such clients as Tyco’s former CEO, Dennis Kozlowski.
