Carter Ledyard Clients Receive Favorable Second Circuit Decision

On May 5, 2016, the Second Circuit Court of Appeals ruled in favor of the firm’s clients, Jake Karam, Kent Hughes, Vladimir Shushkovsky, and Ian Winter.  The Second Circuit affirmed the decision of the District Court for the Southern District of New York granting Carter Ledyard’s motion to confirm an arbitration award and denying petitioner’s motion to vacate the award and for discovery.  The petitioner argued that the arbitration award was the product of fraud and corruption among the arbitrators and other members of the American Arbitration Association.  The Second Circuit agreed with Carter Ledyard that there was no evidence to support the petitioner’s claims against the arbitrators and the AAA.  The firm’s clients were represented by Managing Partner Judith A. Lockhart and litigation associate Michael H. Bauscher.  Mr. Bauscher argued the Second Circuit appeal.
