Carter Ledyard Secures Dismissal of Trademark Opposition

A panel of three Administrative Law Judges of the Trademark Trial and Appeal Board has unanimously dismissed oppositions to two trademark applications filed by Carter Ledyard client Munro Investment Group Pty Ltd. The oppositions were brought by Niche Audio, Inc., a manufacturer and distributor of car audio products, who sought to prevent Munro Investment Group from registering its MAJESTIC brand trademarks for use with various kinds of marine, RV, eco-home, and solar home electronics. In their decision, written by Judge David K. Heasley, the Judges found that Niche Audio had failed to meet its burden of proving either that it had priority of use or that there was a likelihood of confusion between the parties’ marks in the minds of the consuming public.
