Nick Tapert and Chris Rizzo helped client RIS NYC LLC win the dismissal of an Article 78 petition against the client and co-respondent New York City involving the City’s award of an important parking and parking enforcement contract to RIS NYC. The petitioner, IPT LLC d/b/a Paylock, was the losing bidder on the City’s request for proposals and had served as the City’s prior parking enforcement vendor. In his December 17, 2019 decision, Justice Arthur Engoron stated: “Deferring to the DOF’s [Department of Finance’s] expertise in this area, as the law requires, the Court finds that DOF did not act arbitrarily and capriciously in awarding the contract to RIS, as RIS’ proposal received the highest scores in price per technical point.”
