An article written by Preston C. Demouchet, a member of Carter Ledyard’s Trusts & Estates department and recent recipient of a two-year fellowship by the American Bar Association, was recently published in the Fall 2020 edition of the RPTE eReport. Preston’s article details Fairbairn v. Fidelity Investments Charitable Fund, a trial that is currently underway that may have widespread implications for donor-advised funds—an increasingly popular vehicle for charitable giving. Preston maintains that the Fairbairn case is a cautionary tale for fund sponsors who market advisory privileges and later decline recommendations.
