On June 10, 2015, the U.S. Court of Appeals for the Federal Circuit ruled in favor of firm client Kaneka Corporation in its appeal of a summary judgment decision by the U.S. District Court for the Central District of California. The District Court had dismissed Kaneka’s patent infringement action against manufacturers of the dietary supplement coenzyme Q10. Kaneka is the owner of a process patent for manufacturing coenzyme Q10 and has alleged that the defendants’ manufacturing processes infringe Kaneka’s patent. A three member panel of the Federal Circuit unanimously reversed the District Court and remanded the case for further proceedings agreeing with Kaneka’s construction of the claims of the patent. The Federal Circuit’s ruling allows the parties to proceed in the California District Court, and also enables Kaneka to proceed for a trial on a similar infringement action, involving the same patent with different defendants, in the Southern District of Texas. Kaneka is represented by partners Keith D. Nowak, William F. Sondericker, Gerald W. Griffin, associates Theodore Y. McDonough and Andriy R. Pazuniak, and legal assistant Mara Leff.
