Federal Court Recognizes New York’s Interest in Challenging Legality of White House’s Anti-Wind Order

Writing for the New York Law Journal, Christopher Rizzo and Karen E. Meara of Carter Ledyard’s Environmental and Land Use Group break down the wind order, New York’s interest in wind development, the litigation, and the court’s decision.

In July 2025, a court allowed states, including New York and others, to challenge a federal wind energy pause issued by President Donald Trump, ruling the lawsuit can proceed under the APA. The court found the indefinite halt harms renewable energy efforts and economic interests, rejecting government claims that the states lack standing or that the action isn’t final.
