Judith Wallace Quoted in Law360 on Ownership Dispute Over Henry Darger Artwork

November 4, 2026/less than a minute

Judith Wallace, Chair of Carter Ledyard’s Art Law practice, was quoted in a Law360 article titled “Henry Darger’s Landlord Saved His Art. But Who Owns It?” The article examines the ongoing legal dispute over ownership of the late artist Henry Darger’s body of work. The case centers on whether Darger transferred ownership of his works to his landlord before his death in 1973 or whether the works were abandoned. A question a jury is set to decide in March of this year.

Judith provided insight into the legal challenges of establishing abandonment, stating:

“I would not call this the strongest case for abandonment. He was ill, he moved to a nursing home and he died,” said Wallace, who is not involved in the case. “If that were the case, everybody who dies and has property in their home would have abandoned property, and that’s just not the law.”
