On January 6, 2022, United States District Judge Gregory H. Woods issued a decision dismissing all claims brought against Carter Ledyard’s clients Xueyuan Han and several foreign entities in which Mr. Han has an indirect or direct interest. The claims were brought by a Chinese citizen living in California and were related to investment agreements the plaintiff had with some of the defendants. After Carter Ledyard filed a pre-motion letter indicating it would move to dismiss the claims, the Plaintiff dropped all of her federal question claims and filed a second amended complaint which relied solely on diversity jurisdiction. The court dismissed the second amended complaint in its entirety, without leave to amend, due to lack of diversity jurisdiction since both plaintiff and defendants were foreign nationals.
