On October 18, 2018, The 1st Department Appellate Division affirmed a Supreme Court decision upholding New York City’s ban on single-use Styrofoam containers in food service establishments. The decision ended (subject to possible Court of Appeals review) a multi-year effort by Carter Ledyard pro-bono client the Natural Resources Defense Council (NRDC) to help the City draft and implement legislation. Carter Ledyard attorneys Stephen Kass and Karen Meara represented NRDC as amicus in the litigation and in the final round of the administrative agency action that was upheld by the court.
